Managed Services Terms

By accessing or using H190K Store's managed services, you agree to the following terms. These terms are governed by both Turkish and Iraqi law unless otherwise stated.

1. Service Scope

H190K provides managed digital services for clients, including website design and development, managed domain registration, DNS management, and business email setup. Some services may be purchased and managed through third-party platforms such as Spaceship or Cloudflare.

2. Digital Services and Delivery

H190K delivers digital services including but not limited to website development, design, and managed hosting solutions. Project deliverables are provided in digital format. Custom development projects may include source code, design files, and documentation as agreed upon.

3. Payments

  • Payment terms are specified in individual project quotes or service agreements.
  • Services may require upfront payment or milestone-based billing.
  • We accept payment through available payment methods indicated on our website or in communications.
  • Currency and payment processing are handled through our payment providers.

4. Refund and Cancellation Policy

  • Refunds are considered on a case-by-case basis depending on the nature of the service and project stage.
  • For one-time projects, if work has already begun, partial refunds may not be available.
  • For managed services, cancellation may be requested with appropriate notice as specified in your service agreement.
  • Custom work and bespoke projects are generally non-refundable once delivered.

5. Managed Domain Ownership

  • H190K may register and manage domains on behalf of clients.
  • The domain may be held inside H190K's provider dashboard for management purposes.
  • The client remains the intended beneficial owner of the domain if it was purchased for their business.
  • The client may request domain transfer at any time, subject to payment of outstanding invoices, registrar transfer rules, domain lock periods, verification requirements, and technical limitations of the registrar.

6. DNS Management

  • H190K may manage DNS records for client domains.
  • This includes records such as A, CNAME, MX, TXT, SPF, DKIM, DMARC, and other required records.
  • DNS changes may affect website, email, or third-party service availability.
  • H190K is not responsible for outages caused by wrong client-provided information or third-party platform failures.

7. Managed Email Services

  • H190K may create and manage business email accounts for clients.
  • Email services may be provided through third-party providers such as SpaceMail or similar platforms.
  • Clients are responsible for lawful use of their email accounts.
  • Prohibited use includes spam, phishing, fraud, malware, impersonation, illegal activity, or abuse.
  • H190K may suspend or terminate managed email services if abuse, suspicious activity, unpaid invoices, or policy violations are detected.

8. Cloudflare & Hosting Management

  • H190K may host client websites under H190K-managed infrastructure accounts.
  • This may include Cloudflare Pages, Workers, DNS, databases, storage, or similar services.
  • For simple websites, H190K may manage hosting under its own account.
  • For larger projects, sensitive projects, databases, payments, authentication systems, or enterprise projects, H190K may recommend or require a client-owned infrastructure account.

9. Revisions and Project Changes

  • The number of revisions included is specified in your project quote or service agreement.
  • Additional revisions beyond the included scope may be charged separately.
  • Significant scope changes may require a new quote and timeline adjustment.
  • Client feedback should be provided in a timely manner to maintain project schedules.

10. Customer Responsibilities

  • Clients must provide accurate business and contact information.
  • Clients must use services legally and keep account credentials secure.
  • Clients must avoid spam, phishing, fraud, malware, or impersonation.
  • Clients must pay invoices on time and notify H190K about important changes.
  • Clients must review and approve DNS/email/domain changes when requested.

11. Prohibited Use

You agree not to use our services for:

  • Any illegal purpose or activity.
  • Sending spam, phishing emails, or any form of unsolicited communication.
  • Distributing malware, viruses, or any malicious code.
  • Infringing on intellectual property rights of others.
  • Attempting to gain unauthorized access to any systems or networks.
  • Any activity that could harm, disable, or impair our services or infrastructure.

12. Third-Party Providers

  • H190K depends on third-party platforms for domain registration, email, hosting, DNS, storage, payment, analytics, or security services.
  • H190K is not responsible for downtime, policy changes, suspensions, pricing changes, or service interruptions caused by third-party providers.
  • Clients may also be subject to the terms of those third-party providers.

13. Billing, Suspension, and Termination

  • Managed services may be billed monthly, yearly, or as a custom package.
  • Failure to pay invoices may result in suspension or termination of services.
  • H190K may suspend services for abuse, illegal use, spam, phishing, fraud, security risk, or violation of these terms.
  • Domain renewals, email renewals, hosting renewals, and third-party service costs may require advance payment.

14. Intellectual Property

  • Unless otherwise agreed in writing, source code, designs, and technical materials remain the property of H190K Store until full payment is received.
  • After full payment, ownership rights transfer to the client except for proprietary libraries, frameworks, or reusable internal tools.
  • H190K Store may display completed work in its portfolio unless the client requests otherwise.

15. Privacy & Security

  • Your data and project information are handled securely and only used for development purposes.
  • We follow best-practice security standards, but no digital system can be guaranteed 100% secure.
  • H190K may monitor technical indicators related to abuse and security, including login activity and sending volume, without routinely reading client email content.

16. Limitation of Liability

  • H190K Store is not liable for indirect losses, lost profits, email delivery issues, or domain expiration caused by unpaid invoices.
  • H190K Store is not liable for third-party outages, DNS propagation delays, or registrar/provider restrictions.
  • We will make reasonable efforts to maintain services but cannot guarantee uninterrupted availability.

17. Updates & Changes

H190K Store may update these terms at any time. Continued use of our services means you accept the updated terms.
